Tree Surgeons Chigwell Terms and Conditions

Tree surgeons carrying out arboricultural work on a propertyThese Terms and Conditions set out the basis on which tree surgeons in Chigwell provide domestic and commercial arboricultural services. By requesting a quotation, making a booking, or allowing work to begin, the customer agrees that these terms apply to the service contract. They are intended to create a clear understanding of the scope of work, payment expectations, cancellations, safety responsibilities, and the handling of waste generated during tree surgery operations.

In these terms, “we,” “us,” and “our” refer to the service provider, and “you” or “the customer” refers to the person, business, or property owner requesting the work. References to tree surgeons, arborists, tree surgery services, or tree care contractors should be read as meaning the same type of service provision unless stated otherwise. If any part of these terms is found to be invalid or unenforceable, the remainder will continue in full force.

These conditions are designed to apply fairly and reasonably under UK law. They do not replace statutory rights where those rights cannot legally be excluded. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited. Any variation to these terms must be agreed in writing.

1. Booking Process

A quotation and booking arrangement for tree surgery servicesA booking for tree surgery services may begin with an enquiry, site assessment, written quotation, or confirmed instruction from the customer. The booking is not considered final until we have accepted the work and, where required, received any agreed deposit or written confirmation. Verbal discussions may help establish the scope of work, but the final agreement will normally be based on the written quotation or job specification.

Before any appointment is confirmed, the customer must provide accurate information about the site, access arrangements, the number and condition of trees, the presence of obstacles, nearby structures, utilities, protected species, and any relevant permissions. If the information supplied is incomplete or misleading, we may revise the quotation, alter the schedule, or withdraw the booking. Where consent from a landlord, managing agent, neighbour, or local authority is needed, the customer is responsible for obtaining it unless we have expressly agreed otherwise.

Any dates offered for tree work are estimates unless a fixed date has been expressly agreed in writing. Weather conditions, safety considerations, equipment failures, traffic restrictions, or unforeseen site issues may require us to delay or reschedule work. We will use reasonable efforts to inform the customer as early as possible of any change. The customer agrees to ensure that access is available on the agreed date and that the work area is clear of parked vehicles, obstructions, and vulnerable items.

2. Quotations and Scope of Work

Tree care team managing branches and site safetyAll quotations for tree surgeons Chigwell services are based on the information available at the time they are issued. Unless otherwise stated, quotations remain valid for a limited period and may be withdrawn or adjusted if costs change materially or if the job specification is amended. Prices may vary where additional climbing, rigging, traffic management, stump work, or disposal requirements become necessary.

The scope of work will be defined by the quotation, job sheet, or written instruction accepted by both parties. Any task not expressly included should be treated as an extra. Examples include additional pruning, removal of larger volumes of waste, work to hidden defects, urgent callouts, or dealing with hazards not visible during the initial assessment. If extra work is required for safety or practical reasons, we may carry it out only after obtaining the customer’s approval where reasonably possible.

Where tree work is undertaken near property boundaries, fences, sheds, greenhouses, or public areas, the customer acknowledges that minor incidental disturbance may occur as part of a normal arboricultural operation. We will act with reasonable care and skill, but the customer should ensure that valuable or fragile items are removed or protected in advance. The service is provided on the basis that trees are living structures, and results can vary according to species, condition, season, and previous maintenance.

3. Payments

Payment terms for tree surgery services will be stated on the quotation or invoice. Unless otherwise agreed, full payment is due upon completion of the work or within the period stated on the invoice. For larger projects, we may request staged payments or a deposit before the start date. Deposits are normally non-refundable where we have reserved labour, equipment, or a time slot specifically for the customer’s project, subject to any rights that apply under law.

Accepted payment methods may include bank transfer, card payment, or other methods specified in advance. Cash payments may be accepted at our discretion but should not be assumed. If a payment is not received on time, we may charge interest and compensation in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 where applicable, or otherwise recover reasonable costs associated with collection. Any bank charges, failed transaction fees, or reversal costs caused by the customer’s payment method may be added to the account.

The customer must not withhold payment for completed work unless there is a genuine and specific dispute raised promptly and in good faith. If payment is disputed, the undisputed portion remains payable in full by the due date. Retention of title does not usually apply to tree work, but any materials, timber, or waste retained by the customer will only remain their property once all sums due have been settled in full, unless otherwise agreed.

4. Cancellations, Delays, and Access

Tree surgeon removing waste after completed workIf the customer wishes to cancel or postpone a booking, reasonable notice must be given. Cancellation charges may apply where notice is short or where costs have already been incurred, such as staff allocation, machinery hire, traffic control arrangements, or travel preparation. The amount charged will usually reflect the actual loss suffered and the work already undertaken. If we need to cancel or postpone due to unsafe conditions, equipment issues, or circumstances outside our control, we will rearrange the work where reasonably possible.

The customer is responsible for providing safe and lawful access to the site. This includes ensuring driveways, gates, shared access routes, and working areas can be used without obstruction. If access is prevented or materially restricted on the day of attendance, we may charge a call-out fee, waiting time, or cancellation charge, depending on the circumstances. We may also leave the site if continuing would be unsafe or if the customer has failed to secure the area as required.

Where the work is delayed by factors such as severe weather, emergency response duties, utility interference, or third-party access issues, the appointment may be rescheduled without liability for any indirect losses suffered by the customer. We will make reasonable efforts to communicate changes promptly and to agree a new date. However, we are not responsible for costs that arise from the customer’s own arrangements with other contractors, tenants, or visitors.

5. Liability and Insurance

We will carry out work with reasonable care and skill and use suitable equipment and trained personnel. Our liability for foreseeable loss or damage caused by our negligence is limited to the total price paid or payable for the relevant job, except where a greater liability cannot legally be excluded. This limitation does not apply to death or personal injury caused by our negligence, fraud, or any liability that the law prevents us from limiting.

Tree surgery can involve inherent risks, including falling branches, hidden decay, root disturbance, underground services, unstable timber, and unpredictable tree movement. The customer accepts that some level of risk remains even when work is planned carefully. We are not liable for loss or damage resulting from pre-existing defects, structural weakness, decay, subsidence, defective boundaries, or other site conditions that were not caused by our negligence. We do not accept responsibility for items that the customer fails to remove or protect before work begins.

Any claim for damage must be reported as soon as reasonably possible and, in any event, within a reasonable time after the issue is discovered. The customer must allow us a fair opportunity to inspect the matter, gather information, and, where appropriate, remedy the issue. We are not liable for indirect or consequential losses, including loss of profit, business interruption, loss of use, or inconvenience, except where such exclusion is unlawful.

6. Waste Removal and Environmental Compliance

Professional tree surgery team operating under UK termsAll green waste, timber arisings, brushwood, and related debris produced during the work will be handled in accordance with applicable waste regulations. Unless the quotation states otherwise, waste generated by the job will be removed by us and transferred to a licensed waste facility or processed through lawful recycling channels. Where the customer requests to retain logs, woodchip, or other materials, this must be agreed in advance and may affect the price or logistics of the job.

Under UK waste law, the person who produces waste has duties regarding its lawful transfer and disposal. We will take reasonable steps to ensure that waste from our operations is transported only by authorised carriers and disposed of responsibly. Any documentation required for commercial waste handling, transfer notes, or disposal records will be prepared where relevant. The customer must not ask us to leave waste in a location where doing so would breach environmental or local authority requirements.

If the customer asks us to remove third-party waste, contaminated material, invasive plant matter, or items unrelated to the agreed tree work, we may refuse or charge separately for the additional handling involved. We are not responsible for hazardous substances concealed within the site unless we have expressly agreed to manage them and have the right equipment and training to do so. The customer must notify us of any known contamination, asbestos, fuel, chemicals, or biosecurity concerns before work starts.

7. Customer Responsibilities

The customer must ensure that the site is ready for the agreed service and that all relevant permissions have been obtained. This includes consent from other property owners where branches overhang boundaries, permission from occupiers or tenants where applicable, and any planning consent, tree preservation consent, or other authorisation required by law. If a legal restriction applies and has not been disclosed, we may suspend work until the issue is resolved.

The customer should keep children, pets, and unauthorised persons away from the work zone while tree surgeons are operating. The customer must also disclose any concealed hazards, including underground services, septic systems, irrigation lines, weak roofs, restricted load-bearing surfaces, or unstable ground. Where our team reasonably considers that the site is unsafe, we may pause or stop work until the issue is addressed. Delays caused by a failure to provide safe conditions may be charged.

Any instructions given by the customer during the job must be consistent with the agreed scope and with safety requirements. If instructions create a risk to people, property, or plant health, we may decline to follow them. We may also refuse to continue if circumstances change materially, if access is withdrawn, or if the customer acts in a way that compromises safety or professional conduct.

8. Governing Law and General Provisions

These Terms and Conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and interpreted in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, unless the customer is a consumer and mandatory legal rules provide otherwise. This clause does not remove any statutory rights available to consumers under applicable UK legislation.

We may update these terms from time to time to reflect legal, operational, or commercial changes. The version in force at the time of booking will normally apply to that booking unless a later written agreement states otherwise. If we choose not to enforce a right or remedy at any time, that does not prevent us from doing so later. Any notice required under these terms should be provided in a durable written form unless a different method is expressly agreed.

By proceeding with a booking for tree surgeons in Chigwell, the customer confirms that they have read, understood, and accepted these Terms and Conditions. These provisions are intended to support a professional, transparent, and lawful service relationship for all standard tree care and arboricultural works. Where a separate written contract exists, that contract will take precedence to the extent of any inconsistency.
